Where did you read this because 1-25-07 is the date of this and if you have a link to what u are saying please list it , I think you got mixed up on this one Yes or No Notes by Erick G. I seem to also recall that in one of the recent hearings ,I believe the one where the Judge granted all the motions, that he said that if anyone could show just cause why they were unable to mee t the deadline, that they would be allowed to submit their petition to be included as plaintiffs . I know of a bunch of people here in Sioux City that sent their stuff in after one of the recent deadlines this summer, because their so-ca;lled attorneys waited until the day of the deadlline to notify them that they would not accept them., and they submitted just cause evidence.

The extension is for PI and Shak to file their response. Not for people to file papers to be plaintiffs, that deadline has come and gone.

Deadline to turn in packets and documentation On Gary Montana's website I just noticed that he has moved the deadline to submit packets back again to January 30, 2007. Or did he do this already and I just noticed it? vmarier

there is a hearing on Jan. 25th on the issue of the summonses to Shakopee and Prairie Island.. the judge has invited all interested parties to appear whether in person or by phone. we do not know yet what other issues may be addressed at that time, but we think that it is an important hearing in that it will deal with the summonses and maybe that issue will be decided so that the case can move forward. at least I hope that that is the result.

mklaw is just speaking for their own clients not for the intervenor-plaintiffs they have their own attorneys
since this isnt a class action lawsuit, but a group of individuals filing the same lawsuit it will be 2-3 years before this lawsuit gets around to the intervenor-plaintiffs
under the tucker act and the indian tucker act all appeals are put off until the lawsuit is final
and then the only thing that can be appealed is the amount of damages, not any other final judgement, or remedy that the judge imposes
and even then the only one that can appeal is the US government, not the 3 communities even the 3 communities missed the deadline to submit and they did know of this lawsuit
so they cant say they didnt know, and end up prolonging it

The Montana website did not state that the deadline is for new plaintiffs to file. The deadline was for submitting packets and documentation. SHOULD YOU SEND IN RANDOM DOCUMENTS WE WILL ATTEMPT TO RETURN THEM AND WILL CHARGE THE CLIENT MAILING COSTS. ALL PACKETS MUST BE SUBMITTED TO OUR OFFICE BY JANUARY 30, 2007. HOWEVER, IF YOU NEED AN EXTENSION YOU MAY CONTACT US AND WE WILL WORK WITH YOU TO MAKE A DETERMINATION OF A DATE THAT IS ....... That's all I copied.
