In essence, it really doesn't have anything to do with the case we are involved in. The case we are involved with deals with people who did not participate in the Sioux Uprising. They were given land in trust and the government gave the land in trust to the tribe, not the people for whom it was intended. This is not about the government and enrollment. I hope what I said answers your question. However, on the flip side, greed causes destructive behavior and can destroy all we hold sacred. Once again, money seems to be more important than people.  jackie

what if the people on the tribe are legit than basically wouldnt this be the same type of case over enrollment?

The legitimacy issue of tribal members is a separate issue. I still think the case is about the land that was held in trust for loyalist Indians being turned over to the tribe. It was not supposed to be given to other Indians, only the Loyalists.

I agree with Jackie. LD status is the issue here and not tribal membership. I see from the 1886LD website that some are seeking enrollment at Lower Sioux because of the three new council members, and that is their call. I'm enrolled at Santee and have no intention of changing regardless of how the lawsuit is settled. As I said in another thread, the issue being contested by the Governement is the existence of an enforceable trust. I've always had a hard time believing there is such a thing as a "non-enforceable trust", but the Supreme Court has ruled that there indeed is. Tokakte

Speaking of Trust...the Mdewakanton Dakota Nation has had a Tribal Trust Land account since its first treaty agreement. Does anyone out there know what amount is in that account? The Cobell case is about individual Trust monies, but since the Mdewakanton Tribe is mentioning the Trust Land, I think someone should also look into the Tribal Trust Land account for the Tribe. The U.S. Treasury Dept. and the Dept of the Interior is supposed to be collecting the monies for the Trust Land leases and investing them and paying Fair Market value for the lease during the time of lease. I think there should be an inquiry into this as the Statute of Limitations runs out to file for your Tribal Claim on December 31, 2005.

I agree with tokakte....... where I am "enrolled" and what is happening here are of separate issues.....either way I am Dakota, and proud to be so.

GOOD NEWS! As of Friday, Oct. 16, 2005, the Lower Sioux Community Council has voted to file a lawsuit regarding the Tribal Trust Land monies. This means that the Mdewakanton Tribe will get their lawsuit in before the Statute of Limitationsruns out on December 31, 2005. What effect does this have on the Lineal Descendancy Case? It enhances it and strengthens the position of the lineal descendants in the Sheldon Wolfchild case.

Waste!!! I am so glad I am a part of all of this coming togetherness, a part of all you! TIOSPA ye! Oddly enough, it seems you CAN tell who is who when you read their words on here.....nice to know some of us can retain the values of those struggled, fought, and died so we could be here today!!! It calls for another powwow, ennet???

if your father is not an enrolled member of any indian nation. then you are not a tribal member of any indian nation. for example, when your father is white,black,mexican, are other race. by ancestoral rights your not entitled to be an enrolled member of any tribe.
